The Role of Field Sobriety Tests in Arizona DUI Cases

Field sobriety tests (FSTs) are commonly used by Arizona law enforcement officers to assess whether a driver is impaired by alcohol or drugs. These tests are performed at the roadside and are often one of the first tools officers use to establish probable cause for a DUI arrest.

The most widely used FSTs in Arizona are part of the standardized field sobriety test battery approved by the National Highway Traffic Safety Administration (NHTSA). These include:

Horizontal Gaze Nystagmus (HGN): The officer tracks your eye movements to detect involuntary jerking that can indicate alcohol impairment.
Walk-and-Turn Test: The driver must walk heel-to-toe in a straight line, turn, and return while following specific instructions.
One-Leg Stand Test: The driver must balance on one foot while counting aloud for 30 seconds.

Although officers may use these tests to justify an arrest, they are not scientific proof of intoxication. FSTs are subjective and can be influenced by a variety of factors, such as:

– Fatigue or medical conditions
– Uneven terrain or poor lighting
– Nervousness or anxiety
– Language barriers or misunderstood instructions

Can You Refuse Field Sobriety Tests in Arizona?

Yes. Unlike chemical tests (breath, blood, or urine), you are not legally required to submit to field sobriety tests. Refusing to perform FSTs cannot result in license suspension, although officers may still arrest you based on other observations.

How FST Results Are Used in Court:

Officers use FST performance to establish probable cause, which can justify an arrest or a warrant for a blood test. However, in court, your attorney can challenge these results by questioning the officer’s training, test conditions, and your physical or mental state at the time.
