Why Hire A DUI Attorney

Arizona is a zero-tolerance state regarding driving under the influence. Around 28% of traffic deaths in the state in 2017 were alcohol or drug-related. As such, the state is serious about enforcing DUI laws. Deciding to use a DUI defense attorney, then learning how to find the best DUI attorney is of utmost importance.

Minimize Arizona DUI Penalties

Not only does a Phoenix DUI lawyer help you navigate a complicated legal system, they try to work out the best outcome for you. This may include getting the charge thrown out, reduced, or negotiating a plea deal. For example, if evidence was illegally obtained, they can get it thrown out. Or they can help get witnesses that will testify in your favor. These types of things are difficult to achieve with inadequate counsel.

Depending on whether your DUI charge is a misdemeanor of felony, there are a wide variety of penalties and consequences to consider, including: prison time, fines, loss of job or wages, vehicle impoundment, ignition interlock devices, and losing basic rights such as driving, voting, or owning a gun. DUI convictions can even impact divorce cases, which is critical when child custody decisions are being made.

What Are The Penalties For A DUI In Arizona?

Being charged with driving with a BAC of at least .08% is no small matter in Arizona, and if you’re a commercial driver you can be charged if your BAC is at least .04%. Those with a BAC above 0.15% can be charged with an extreme DUI.

In addition to the penalties listed below, if you are arrested for DUI, you will be required to have an ignition interlock device installed on their vehicle. The device requires you to blow into it and pass a BAC test in order to start your vehicle.

  • First offense – Minimum of 1 to 10 days in jail, fines in excess of $1400, and potential license suspension of 30 to 90 days. (365 days if refused to give blood, breath, urine)
  • Second offense – Minimum of 30 to 90 days in jail, $500+ fine, and 1-year license suspension
  • Third offense – 4+ months, fines in excess of $4700, and 1 to 3 year license revocation.
  • Extreme DUI (0.15 BAC) – 9 to 30 days of jail, and $2,500+ fine
  • Super Extreme DUI (0.20 BAC) – 14 to 45 days of jail, and fine in excess of STATE AMOUNT.

According to the Arizona Department of Public Safety, the following interventions have been developed to help deter repeat offenders:

  • Automobile impoundment
  • Ignition interlock
  • Electronically monitored house arrest
  • Intensive probation supervision with treatment

Understand Your DUI Case

Facing criminal charges is an emotionally catastrophic experience, made worse by how confusing every step of the process can be. From the time you’re pulled over to the time that a decision on your case is released, you are bound to be faced with countless confusing and difficult situations and decisions. A well-established criminal defense attorney can help you navigate these situations.

As much as knowing your way around a courtroom is important, it is equally important for a good Phoenix criminal defense lawyer to be your advocate in the process. It’s important to feel in full control of what could happen to your future, and to know the exact pros and cons of each decision you make. If you’re trying to do this on your own, you will not have that protection.

Control the Cost Of Your DUI Sentence

The cost of a DUI lawyer will depend in part on the type of charge your facing. The best way to get the most accurate number is to call around for free consultations. The cost does not include court costs, fines, towing, or other related expenses such as another means of transportation until your case has a judgement.

When researching prices, it’s also important to keep in mind the potential costs you may face if the outcome doesn’t go your way. This may include lost wages due to jail or prison time, alcohol treatment programs, ignition interlock systems, and rising car insurance premiums.
